These terms and conditions outline the rules and regulations for the use of Daniel Garbett's Website, Programs and Events.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: "Client", "You" and "Your" refers to you, the person accessing this website and accepting the Company's terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company and parties “The Thrive Academy”, “Daniel Garbett”, and “Mikaila Hansen Lee-Leong”. "Party", "Parties", or "Us", refers to both the Client and ourselves, or either the Client or ourselves. 

 

All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services/products, in accordance with and subject to, prevailing law of Australia. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Any information that forms part of our online and in-person experiences is not to replace any medical or healthcare advice from a qualified professional. We recommend seeking a professional healthcare practitioner when needed.

Where applicable, we will send you any forms to advise us of any mental or physical health conditions and dietary requirements prior to the start date of the event. Please ensure you disclose all information to us if you have any health conditions and/or dietary requirements that may be affected by the activities offered on our retreats.

We ask that you be mindful at all times of your own body’s capability during the event and adjust your participation accordingly.

If you are concerned about your health, please check with your doctor prior to making your booking, to ensure that you are sufficiently fit and healthy to undertake physical activities that you may do whilst on participating in workshops, programs, events and retreats.

We welcome all guests and staff regardless of medical choices.

All bookings must be made via our website www.danielgarbett.com

PAYMENT POLICY

Retreats & Workshops

Payment must be received by us in full, prior to the EVENT start date. If the payment has not been received by us prior to the start date, the cancellation policy will apply.

Online Experiences

Payment is charged upon purchase. If a payment is not received or payment method is declined, access to your online subscriptions/purchase will be removed.

Monthly Membership / Subscription

Payment is charged for the first month upon purchase. If a payment is not received or payment method is declined, access to your online subscriptions/purchase will be removed.

CANCELLATION POLICY

Retreats

  1. Cancellations made up to 90 days before the retreat start date:
    a) will receive a full refund less a $250AUD cancellation fee,
    b) or can be issued a retreat credit for the ticket price paid, valid for one year, which can only be transferred to another retreat one time.

  2. Cancellations made between 45 to 90 days before the retreat start date will result in a loss of 50% of the trip price.

  3. Cancellations made less than 45 days before the retreat start date will result in a total loss of funds.
    a) If you are able to find a replacement for your booking, then the cancellation fee will not apply.
    b) The Thrive Academy, Daniel Garbett, or Mikaila Hansen Lee-Leong will not be responsible for finding a suitable replacement; it is the responsibility of the ticket holder.
    c) Transfers must be advised and completed no later than 2 weeks prior to the retreat start date.

  4. We reserve the right to cancel the trip if it is not meeting the retreat minimum. If we do so, you will be refunded in full.

  5. If we find that the trip is not a good fit for you, we reserve the right to cancel your reservation, in which case your payments will be fully refunded.

  6. If the change or cancellation is due to a major event (i.e., political unrest, war or threat of war, riots, civil strife, closure of airports or ports, industrial disputes, terrorist activity, natural and nuclear disasters, fire, Acts of God, adverse weather, or other similar events beyond the control of The Thrive Academy, Daniel Garbett, or Mikaila Hansen Lee-Leong), there will be no refunds given. Please ensure your travel insurance policy covers you for any cancellations.

Trip cancellation insurance is always recommended whenever making travel plans.

Workshops and Events

  1. 7-Day cooling-off period from the day of purchase for a full refund (less a AU$15 cancellation fee).

  2. After the cooling-off period, tickets are nonrefundable.

  3. If you are able to find a replacement for your booking, then the above cancellation terms will not apply.
    a) The Thrive Academy, Daniel Garbett, or Mikaila Hansen Lee-Leong will not be responsible for finding a suitable replacement; it is the responsibility of the ticket holder.
    b) Transfers must be advised and completed no later than 2 days before the event start date.

  4. We reserve the right to cancel the workshop if it is not meeting the workshop minimum. If we do so, you will be refunded in full.

  5. If we find that the workshop is not a good fit for you, we reserve the right to cancel your reservation, in which case your payments will be fully refunded.

  6. If the change or cancellation is due to a major event (i.e., political unrest, war or threat of war, riots, civil strife, closure of airports or ports, industrial disputes, terrorist activity, natural and nuclear disasters, fire, Acts of God, adverse weather, or other similar events beyond the control of The Thrive Academy, Daniel Garbett, or Mikaila Hansen Lee-Leong), there will be no refunds given.

    Please ensure your travel insurance policy covers you for any cancellations.


Online Experiences / Single Programs

Upon purchase, if you are not fully satisfied within the first 7 days, you can request a full refund by emailing team@danielgarbett.com

Membership / Subscription

Can be canceled anytime with no lock-in contracts. Your subscription access will be complete at the end of the monthly billing cycle to which you signed up. If you purchased a yearly subscription, there will be a pro-rata monthly charge and $50 AUD admin Fee deducted from the yearly subscription for the duration of your subscription.

TRAVEL INSURANCE

When attending our Events, Workshops and Retreats we strongly recommend you take out a comprehensive level of travel insurance for cancellation, personal injury, death, medical expenses, repatriation expenses and evacuation expenses before you travel. We recommend that your insurance covers cancellation, personal liability and loss of personal property. Please check that your insurance covers all of the activities you are going to be participating in. Some policies exclude certain adventure activities.

We cannot be held responsible for your failure to take out appropriate insurance. You also agree to indemnify us against all third-party claims, actions, damages and remedies which may be brought against us in respect to your participation in the Events, Workshops and Retreat.

TRAVEL ARRANGEMENTS:

All travel arrangements including Passports, VISAS and other required travel documentation, including travel insurance, are the responsibility of the participant. Any fines, penalties, payments or expenditure incurred as a result of such documents not meeting the requirements of travel authorities will be the participants’ responsibility. Any non-attendance at the retreat due to insufficient travel arrangements will be treated as a cancellation and our cancellation policy will apply.

PHOTOGRAPHS / VIDEO FOOTAGE

At various times throughout the retreat we may take photographs and/or video footage. We may use these images/video footage on our social media, website or other marketing material. Participants are deemed to have given consent to using these images and recordings as stated. If you have any concerns regarding this, please advise us prior to making your booking.

ACKNOWLEDGEMENT & ACCEPTANCE

By proceeding with your booking, you acknowledge and accept the following:

I have read the above Terms and Conditions and understand the information pertaining to the service. I am aware I must be covered by my own travel insurance appropriate to the activity in order to participate in Events, Workshops and Retreats and will not hold The Thrive Academy, Daniel Garbett, or Mikaila Hansen Lee-Leong responsible.

LIABILITY & WAIVER

I understand that some of the processes may be physically, mentally and emotionally intensive, and I voluntarily assume the risk inherent in my participation in the sessions with The Thrive Academy, Daniel Garbett, or Mikaila Hansen Lee-Leong, including the risk of injury, death, loss, cost or damage to my person or property. I release and indemnify The Thrive Academy, Daniel Garbett, and Mikaila Hansen Lee-Leong from, and against, any and all such claims and liabilities, including legal fees.

I further attest that I have sufficient physical health and/or that I have consulted with a physician and I am able to undertake and engage in all the activities I have chosen to partake in with The Thrive Academy, Daniel Garbett, or Mikaila Hansen Lee-Leong.

I agree to refrain from coming to the event if I have COVID-19, cold/flu-like symptoms, or have been a “close contact” until the time that it is safe to do so. While at the event, I will ensure to practice good hygiene and abide by required COVID19 precautions.

I acknowledge and understand it cannot be guaranteed that the event will be free of COVID19, even when all appropriate safety measures are taken. Therefore, I also acknowledge that under relevant work health and safety and workers compensation laws, I will not hold The Thrive Academy, Daniel Garbett, or Mikaila Hansen Lee-Leong responsible if this circumstance does arise.

I give permission for The Thrive Academy, Daniel Garbett, and Mikaila Hansen Lee-Leong to use photographs and/or video and audio taken of me for promotional purposes.

Using breathwork as a tool for exploring altered states of consciousness can significantly enhance your personal growth journey. However, it's crucial to recognise that this process may evoke intense emotions and physical sensations. Therefore, individuals with specific conditions such as recent head injuries, recent surgeries, psychosomatic issues, severe mental health concerns, or physical limitations are advised against participating. If you are pregnant, please reach out to the facilitator for guidance.

Additionally, please be aware that consuming cacao is not recommended if you have a heart condition (as it can elevate heart rate) or if you are currently taking anti-depressant and/or anti-psychotic medication. Cacao consumption may lead to migraines and nausea. It is your responsibility to make it known if this is the case, however you are still encouraged to join us for the breathwork session!
